Poland is set to implement significant changes to its work permit and immigration legislation, effective January 1, 2025. Key updates include:

Mandatory Employment Contracts

Foreign nationals will be required to work under employment contracts, eliminating the option of civil law contracts (e.g., service contracts). This change aims to enhance job security and working conditions for foreign workers. Exceptions apply to holders of the EU Blue Card, Ukrainian citizens, and those exempt from work permit obligations.

 

Increased Work Permit Fees

The new legislation introduces fee caps for work permits:

  • Standard Work Permits: Fees may be set up to the minimum wage (currently 4,300 PLN gross).

  • Seasonal Work Permits and Declarations: Fees may be up to 10% of the minimum wage.

These adjustments could increase the cost of employing foreign nationals.

 

Digitalization and Process Streamlining

The application process for work permits will become fully electronic, aiming to reduce processing times and improve efficiency. Additionally, the labor market test requirement will be eliminated, simplifying the hiring process for employers.

 

Enhanced Monitoring and Penalties

The new regulations introduce stricter documentation requirements for employers and increased penalties for the illegal employment of foreigners, reinforcing compliance and oversight.

 

Visa Requirements for Colombian Nationals

As of August 15, 2024, Colombian nationals entering Poland for work purposes must obtain a visa, regardless of the duration of their stay. This measure aligns with Poland's efforts to regulate its labor market more effectively.
